1. Acceptance of Terms

These Terms of Service ("Agreement") govern your access to and use of the MacroPulse website, application, API, and all related services provided by MacroPulse ("Service" or "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. If you do not agree, you must not access or use the Services.

MacroPulse may revise, update, or otherwise modify this Agreement at any time, with or without notice. The most current version will always be available on this page. Your continued use of the Services after any modification constitutes acceptance of the revised terms.

2. Description of Services

MacroPulse provides market timing intelligence derived from publicly available economic and financial data. Our Services include, but are not limited to:

Macro Market Timing Indicator (MMTI): A composite score synthesizing multiple economic signals into a single market timing indicator for the US and Korean markets.
Signal Contributions: Normalized scores from individual economic indicators that feed into the composite MMTI score.
Market Sentiment Analysis: AI/LLM-generated sentiment assessments based on macroeconomic news and commentary.
Economic Signal Data: Processed and normalized time-series data from publicly available sources including central banks, statistical agencies, and financial data providers.

MacroPulse is a data and analytics service that adds value to publicly available information through collection, normalization, weighting, and composite scoring. It is not a brokerage, investment adviser, or financial planner.

3. No Investment Advice

IMPORTANT: MacroPulse does not provide investment advice, financial advice, or personalized recommendations of any kind.

3.1 Not Investment Advice. The Services provide informational and analytical content based on publicly available data. Nothing contained on the Service constitutes a recommendation that any particular security, portfolio of securities, transaction, or investment strategy is suitable for any specific person. You should not treat any content on the Service as investment advice.

3.2 Not a Fiduciary. MacroPulse is not a registered investment adviser, broker-dealer, or fiduciary. No advisor-client, fiduciary, or principal-agent relationship is created by your use of the Services.

3.3 No Solicitation. Nothing on the Service constitutes an offer to sell, a solicitation of an offer to buy, or a recommendation to purchase or sell any security, financial product, or investment instrument.

3.4 Your Responsibility. YOU ALONE ARE SOLELY RESPONSIBLE FOR DETERMINING WHETHER ANY INVESTMENT, SECURITY, OR STRATEGY IS APPROPRIATE FOR YOU BASED ON YOUR INVESTMENT OBJECTIVES AND PERSONAL AND FINANCIAL SITUATION. You must exercise your own due diligence and consult with qualified financial, legal, and tax professionals before making any investment decisions.

3.5 Risk of Loss. ALL INVESTMENTS INVOLVE RISK, INCLUDING THE POSSIBLE LOSS OF PRINCIPAL. Past performance, backtested results, and historical data presented on the Service are not indicative of future results. There is no guarantee that any investment strategy will be profitable.

3.6 Impersonal Content. Any information, scores, indicators, or analysis provided through the Service is impersonal and not tailored to the investment needs of any specific person. It does not account for your individual financial circumstances, risk tolerance, or investment objectives.

4. Data and Content Disclaimer

4.1 Third-Party Data. The Services incorporate data from third-party providers including, but not limited to, the Federal Reserve Economic Data (FRED), the Bank of Korea (BOK), the European Central Bank (ECB), and other publicly available sources. MacroPulse does not independently verify the accuracy, completeness, or timeliness of data obtained from these sources.

4.2 AS IS Basis. ALL DATA, CONTENT, INDICATORS, SCORES, AND ANALYTICS PROVIDED THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, AND NON-INFRINGEMENT.

4.3 No Guarantee of Accuracy. MacroPulse does not and cannot guarantee the accuracy, reliability, currentness, completeness, or suitability of any data, calculation, composite score, or analysis provided through the Services. Errors, delays, omissions, or interruptions may occur.

4.4 Model Limitations. The MMTI composite score, signal contributions, and other indicators are produced by mathematical models that inherently involve assumptions, approximations, and simplifications. Model outputs are probabilistic, not predictive. Different models or configurations may produce materially different results.

4.5 AI-Generated Content. The Services include market sentiment analysis generated by large language models (LLMs) and other artificial intelligence techniques. AI-generated content has known and unknown limitations, including the potential for inaccuracy, bias, and hallucination. AI-GENERATED SENTIMENT SCORES DO NOT CONSTITUTE FINANCIAL, INVESTMENT, OR ANY OTHER FORM OF ADVICE AND SHOULD NOT BE RELIED UPON AS SUCH. You acknowledge that AI-generated content may be inaccurate and assume all risk associated with its use.

4.6 Hypothetical Performance. Where the Services present historical or backtested performance data, such results are hypothetical and prepared with the benefit of hindsight. HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS, INCLUDING THE FACT THAT THEY DO NOT REPRESENT ACTUAL TRADING AND MAY NOT REFLECT THE IMPACT OF MATERIAL MARKET AND ECONOMIC FACTORS. THERE ARE FREQUENTLY SHARP DIFFERENCES BETWEEN HYPOTHETICAL PERFORMANCE RESULTS AND ACTUAL RESULTS SUBSEQUENTLY ACHIEVED. PAST PERFORMANCE IS NO GUARANTEE OF FUTURE RESULTS.

5. User Responsibilities

5.1 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify MacroPulse immediately of any unauthorized access or use of your account.

5.2 Tier Compliance. The Services offer tiered access levels (Explorer, Insider, Pro). You agree to use the Services only within the scope of your subscribed tier and not to attempt to circumvent access restrictions.

5.3 Prohibited Activities. You agree NOT to:

Copy, redistribute, transmit, sell, sublicense, publish, or commercially exploit any data, scores, or content from the Services, except as expressly permitted by your subscription tier;
Use bots, scrapers, spiders, crawlers, automated scripts, or other automated means to access or extract data from the Services beyond documented API rate limits;
Reverse engineer, decompile, or attempt to derive the underlying algorithms, weighting schemes, or proprietary methodology of the MMTI or any other indicator;
Use the Services to develop, train, or enhance competing products, datasets, or machine learning models;
Interfere with or circumvent security controls, authentication systems, rate limits, or access restrictions;
Remove, obscure, or alter any proprietary notices, watermarks, or attributions in the Services;
Share your account credentials with third parties or allow others to access the Services through your account.

5.4 Compliance. You are responsible for ensuring that your use of the Services complies with all applicable local, national, and international laws and regulations.

6. Intellectual Property

6.1 Ownership. All content, data, graphics, composite scores, indicator methodologies, weighting schemes, software, layout, trademarks, trade dress, and other materials made available through the Services ("Content") are the exclusive property of MacroPulse or its licensors. All rights not expressly granted in this Agreement are reserved.

6.2 Proprietary Methodology. The MMTI composite scoring methodology, signal weighting schemes, normalization algorithms, and sentiment analysis pipelines are proprietary to MacroPulse. You may not reverse engineer, replicate, or redistribute these methodologies.

6.3 Limited License. Subject to your compliance with this Agreement and your subscription tier, MacroPulse grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial informational purposes only.

7. Subscription, Billing, and Cancellation

7.1 Subscriptions. Paid subscription tiers (Insider, Pro) are billed in advance on a monthly or annual basis as selected at checkout. Pricing is displayed on the subscription page and may be changed with prior notice.

7.2 Payment Processing. Payments are processed securely through our payment provider (PayPal). By subscribing, you authorize MacroPulse and its payment processor to store your payment method and process recurring charges until cancellation.

7.3 Free Tier. The Explorer tier is provided at no charge with limited functionality. MacroPulse reserves the right to modify, suspend, or discontinue any aspect of the free tier at any time.

7.4 Cancellation. You may cancel your subscription at any time through your account settings. Cancellation prevents future billing but does not entitle you to a refund for the current paid period, during which access will remain active until the period ends.

7.5 Refunds. All payments are final and non-refundable once a billing period starts, except where required by applicable law or granted at MacroPulse's sole discretion (e.g., duplicate billing or verified technical access issues).

8. Limitation of Liability

8.1 No Liability for Investment Losses. UNDER NO CIRCUMSTANCES SHALL MACROPULSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSSES RELATED TO TRADING, INVESTMENT, OR FINANCIAL DECISIONS, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF DATA, OR LOSS OF CAPITAL, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF MACROPULSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 No Liability for Data Errors. MacroPulse shall not be liable for any losses, damages, or costs arising from errors, delays, omissions, or interruptions in data, calculations, scores, or analytics provided through the Services.

8.3 Liability Cap. IN ALL CASES, MACROPULSE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO MACROPULSE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8.4 Time Limit. Any claim arising out of or related to the Services must be brought within one (1) year after the claim arose, or it shall be permanently barred.

8.5 Assumption of Risk. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICES AND YOUR RELIANCE ON ANY DATA, INDICATORS, OR ANALYTICS PROVIDED THEREBY.

9. Indemnification

You agree to defend, indemnify, and hold harmless MacroPulse and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of or inability to use the Services;
Your violation of this Agreement;
Your violation of any applicable law or regulation;
Your misuse of any data, scores, or content obtained through the Services; or
Any investment decision made in reliance on the Services.

10. Third-Party Data Providers

10.1 The Services incorporate data from third-party providers. These providers make no representations or warranties, express or implied, with respect to the data, including without limitation any implied warranties of merchantability, quality, or fitness for a particular purpose. Neither MacroPulse nor its data providers shall be liable for any errors, omissions, or interruptions in data.

10.2 Data sourced from the Federal Reserve Bank of St. Louis (FRED) is provided for informational purposes and is subject to the FRED Terms of Use. FRED data is not verified for accuracy by MacroPulse.

10.3 Reserved.

10.4 Data sourced from the Bank of Korea (BOK) and the European Central Bank (ECB) is publicly available economic statistics provided without warranty of accuracy or completeness.

10.5 You acknowledge that third-party data providers disclaim all liability for any losses, damages, or costs arising from the use of or reliance on their data.

11. Termination

MacroPulse may, at its sole discretion, suspend or terminate your access to the Services, with or without notice, for any conduct that violates this Agreement or is otherwise harmful, abusive, or unlawful. Upon termination, all provisions of this Agreement that by their nature should survive termination shall remain in effect, including but not limited to Sections 3, 4, 8, 9, and 10. No refunds will be issued upon termination except where required by applicable law.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Republic of Korea, without regard to its conflict-of-law principles. Any disputes arising out of or related to this Agreement shall be resolved in the courts of the Republic of Korea. If you access the Services from other jurisdictions, you do so on your own initiative and are responsible for compliance with applicable local laws.

13. General Provisions

13.1 Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.2 Entire Agreement. This Agreement constitutes the entire agreement between you and MacroPulse regarding the use of the Services and supersedes any prior agreements or understandings.

13.3 No Waiver. The failure of MacroPulse to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

13.4 Assignment. You may not assign or transfer this Agreement or your rights hereunder without MacroPulse's prior written consent. MacroPulse may assign this Agreement without your consent.
